These Terms of Service ("Terms") govern your access to and use of GlobalSpatialWork ("Platform", "we", "us"), a global GIS freelancing and jobs marketplace operated from India and available at globalspatialwork.com. By registering an account or using the Platform you agree to be bound by these Terms, our Privacy Policy and Refund & Cancellation Policy.
These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder. This document does not require a physical or digital signature.
You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 (or the equivalent law of your jurisdiction). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current and complete information and keep it updated.
The Platform connects clients who need geospatial/GIS services with independent freelancers and companies. GlobalSpatialWork is an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. We are not a party to contracts formed between clients and freelancers; however, project payments may be held in escrow by our payment partners until work is accepted, per our escrow rules.
Freelancers are independent contractors, not employees, agents or representatives of GlobalSpatialWork.
Payments are processed by third-party payment gateways (Razorpay, PayPal, Stripe). Escrowed funds are released to the freelancer on client approval or per the auto-release schedule shown on the project. The Platform charges a service fee (commission) on transactions, displayed before payment. Withdrawal of earnings requires successful KYC verification, in line with RBI and AML requirements.
You agree not to post or transmit content that is unlawful, defamatory, obscene, infringing, misleading, or otherwise objectionable under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. You must not: circumvent the Platform to avoid fees; misrepresent your identity or qualifications; upload malware; scrape the Platform; or infringe third-party intellectual property.
Unless otherwise agreed in a project contract, intellectual property in deliverables transfers to the client upon full payment of the applicable milestone, subject to the freelancer's pre-existing tools and libraries. The Platform name, logo and software remain the property of GlobalSpatialWork.
Users may raise disputes through the Platform's dispute resolution system. Our administrators review evidence and issue decisions, which may be appealed within the configured appeal window. Platform decisions on escrowed funds are final after the appeal process concludes.
We may suspend or terminate accounts that violate these Terms, applicable law, or that present fraud or security risk. You may close your account at any time; obligations accrued before closure survive termination.
The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, GlobalSpatialWork's aggregate liability for any claim shall not exceed the fees paid by you to the Platform in the six (6) months preceding the claim. We are not liable for indirect, incidental or consequential damages, or for the acts or omissions of users.
These Terms are governed by the laws of India. Courts of competent jurisdiction in India shall have exclusive jurisdiction, subject to any mandatory consumer protections available in your place of residence.
Complaints regarding the Platform or its content may be directed to our Grievance Officer (see the Grievance Officer page). We acknowledge complaints within 24 hours and resolve them within 15 days, per the IT Rules, 2021.
We may update these Terms from time to time. Material changes will be notified on the Platform. Continued use after changes constitutes acceptance.
